Access to the Application

You are granted a limited, non-exclusive, and non-transferable right to access and use the application through the internet, based on the features available in your selected plan (Free, Basic, or Advanced). No additional software installation or hardware setup is required. 

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. If you suspect unauthorized access, you must notify us immediately.

Acceptable Use and Industry Restrictions

You agree to use our services only for lawful business purposes. Our services are not available to businesses operating in:

• Gambling, gaming, or betting operations
• Bars, nightclubs, or establishments primarily serving alcoholic beverages
• Interest-based lending or financial services involving usury
• Any industry that conflicts with our ethical business standards

We reserve the right to suspend or terminate services to such businesses at our discretion.

Data Ownership and Privacy

All content, files, or data that you create, or upload remain your sole property.

• KAISPE does not sell or share your data with third parties. We only access your data to provide technical support, maintain service performance, or improve features.

If required by law, we may disclose your data but will do so only to the extent legally necessary. Please review our Privacy Policy for more detailed information.

Subscription and Billing

For paid plans:

• Billing is processed on a monthly or annual cycle, based on the option you select.
• You will receive prior notice before subscription renewals.
• All fees are non-refundable unless otherwise stated in writing.

If a payment fails or your subscription lapses, access to certain features may be paused until billing details are updated.

You are responsible for all applicable taxes or government charges related to your subscription.

Plan Limits

Your access to the application is subject to the usage limits and features defined in your selected plan. Upgrading to higher plans or adding additional features may require a separate subscription or one-time add-on

Support and Updates

We continuously update the platform to enhance performance, security, and usability.

• All plans automatically receive regular updates.
• Paid plans are eligible for priority customer support.
• While we aim to provide reliable services, we do not guarantee uninterrupted or error-free operation

Cancellation and Data Retention

You may cancel your subscription at any time through your account settings or by contacting our support team.

• After cancellation, your data will remain available for export for a limited period (typically 30 days).
• Beyond this period, KAISPE may permanently remove your data from our systems. We strongly recommend exporting your data before the retention period ends.

Custom Integrations

Any integration with third-party systems (e.g., ERP, CRM, or other applications) is treated as a separate service and may involve additional scope, costs, and timelines.

Service Availability

We strive to maintain a high level of uptime and service performance. However, planned maintenance, unexpected technical issues, or service interruptions may occur.

When possible, we will provide advance notice of scheduled downtime. 

Fair Usage

You agree to use the application in a lawful, fair, and responsible manner.

• KAISPE reserves the right to suspend or terminate access if it determines that your use involves misuse, excessive resource consumption, or violation of these Terms.

Intellectual Property

All content on our application is owned by or licensed to KAISPE and is protected by applicable intellectual property laws.

You may not copy, modify, distribute, or reverse engineer our software.

Limitation of Liability

To the fullest extent permitted by law, KAISPE shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the application.

• Our total liability is limited to the amount you paid in the preceding 12 months.
• The service is provided "as is" without warranties of any kind.

Indemnification

You agree to indemnify and hold KAISPE harmless from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

Changes to Terms

We may revise these Terms from time to time. Continued use of the application after updates means you accept the modified Terms.

• Material changes will be communicated via email or service notification.
